"AS-IS, WHERE-IS" Basis

All items, especially used or pre-owned goods, are sold on an "AS-IS, WHERE-IS" basis. The buyer acknowledges that they rely on their own inspection and communication with the seller regarding the item's condition, functionality, and description.

User Responsibilities & Conduct

You agree not to use the Platform to:

Important Disclaimer

NOTCHLENS IS NOT A PARTY TO ANY AGREEMENTS OR TRANSACTIONS ENTERED INTO SOLELY VIA THE CHAT SYSTEM.

All terms, including but not limited to price, condition, warranty, and return policies, are to be negotiated and agreed upon directly between the buyer and the seller. Notchlens disclaims all liability arising from such peer-to-peer interactions.

TO THE FULLEST EXTENT PERMITTED BY LAW, NOTCHLENS GLOBAL ALLIANCE LTD, ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOST PROFITS, DATA LOSS, OR DAMAGES RESULTING FROM TRANSACTIONS, COMMUNICATIONS, OR THE CONDITION OF ANY ITEMS.

They govern your conduct in all Notchlens-related communities, whether hosted on our Platform or on third-party services (e.g., WhatsApp, Telegram, Discord).

Nature of the Network & Disclaimer

2.1 Curated Community

The Seller Network is a curated community for collaboration, feedback, and education. Access may be gated by a subscription fee.

2.2 Monetary Rewards & Tokenized Ecosystem Disclaimer

Any points, tokens, or rewards distributed within the Network have no guaranteed cash value and are not financial instruments.

Notchlens reserves the sole right to manage, modify, or discontinue the reward system at any time.

Code of Conduct for All Channels

You agree not to engage in the following across all community channels:

	Financial Misconduct	Offering unauthorized financial advice, promoting pyramid schemes, or facilitating off-book transactions that circumvent Notchlens's official marketplace and fees
	Harassment & Defamation	Engaging in hate speech, bullying, or making false statements that harm the reputation of other members or Notchlens
	Information Misuse	Sharing confidential business intelligence, member personal data, or any information shared in confidence within the Network
	Impersonation	Misrepresenting your identity or affiliation with Notchlens or other brands
	Spam & Unsolicited Promotion	Advertising unrelated services or products without prior authorization

Intellectual Property & Content Licensing

4.1 Content License

By posting content (ideas, feedback, images) in the community, you grant Notchlens a perpetual, royalty-free license to use that content for the improvement of our services, without any obligation to compensate you.

4.2 Network Discussions

All discussions, especially regarding new features or business strategies, are the intellectual property of Notchlens.

Liability & Indemnification

5.1 Off-Platform Disclaimer

Notchlens is not liable for any interactions, transactions, or damages that occur as a result of connections made in off-platform communities (e.g., scams, bad deals arranged on WhatsApp).

Engagement is at your own risk.

5.2 Indemnification

You agree to indemnify Notchlens for any losses arising from your breach of these Guidelines in any community channel.

Forfeiture of accrued rewards or tokens

Member Behavior & Dispute Resolution

7.1 Expected Standards of Conduct

Members of the Notchlens Seller Network are expected to act as professional peers. This includes:

Engaging in respectful dialogue, even during disagreements

Assume Good Faith

Assuming good faith in other members' communications

Respect Privacy

Respecting the privacy and confidentiality of community discussions

Use Official Channels

Using official channels for transactions to ensure protection

7.2

Formal Dispute Mitigation Process

In the event of a dispute between members (e.g., accusations of misconduct, intellectual property theft, breach of confidence), the following process shall be followed:

Step 1: Direct Resolution

Parties are strongly encouraged to resolve the issue directly and amicably.

Step 2: Formal Mediation Request

If direct resolution fails, either party may submit a formal request for mediation to Notchlens, providing all relevant evidence (screenshots, chat logs, etc.).

Step 3: Notchlens as Mediator

Notchlens will appoint a neutral internal party to review the evidence and facilitate a non-binding resolution between the parties.

Step 4: Arbitration & Ruling

If mediation fails, Notchlens will act as a binding arbitrator. We reserve the right to make a final ruling, which may include:

Issuing a formal warning

Ordering specific actions

Temporary suspension

Permanent removal

Acceptance of Arbitration

By using the Network, members agree to accept Notchlens's final decision as binding and waive the right to litigate such disputes in court.

7.3 Frivolous Claims

Members who repeatedly initiate bad-faith or frivolous disputes may themselves be subject to sanctions, including suspension or removal from the Network.

Hazardous Materials

Explosives, flammable substances, or dangerous chemicals

Zero Tolerance

Any attempt to list prohibited items will result in immediate account suspension and potential legal action.

Prohibited Conduct

In using our platform, you will not:

	Impersonation & Identity Misrepresentation	Impersonate any person or entity, including but not limited to brands, manufacturers, celebrities, or other users; create a false identity; or misrepresent your affiliation with a person or entity. This includes creating usernames, profile information, or listings that would mislead a reasonable user into believing you are someone you are not.
	Harass or Defame	Use the chat system or any platform feature to harass, abuse, threaten, or defame other users
	Fraudulent Activity	Engage in any fraudulent or deceptive activity, including manipulating prices or interfering with other users' transactions
	Circumvention	Attempt to circumvent Notchlens's transaction processes or fees by taking communications or transactions off-platform
	Intellectual Property Infringement	List items that infringe on any third party's copyright, trademark, or other intellectual property rights

Platform Integrity

Maintaining a safe and trustworthy marketplace requires all users to follow these conduct guidelines.

Notchlens reserves the right, but not the obligation, to investigate any potential violation of this AUP. We may, at our sole discretion:
